The Case

In October 2023, Providence Police conducted a traffic stop on an out-of-state vehicle for a minor violation. What should have been a routine stop quickly escalated when officers extended the detention without justification and proceeded to search the vehicle and its occupants without consent. During the search, a firearm was discovered on our client, who did not have the necessary Rhode Island permit.

The Legal Battle:
Facing a decade behind bars, our client’s future was on the line. However, Attorney Brianna C. Repetto immediately recognized critical constitutional violations in the way the search was conducted. She filed a Motion to Suppress, challenging the legality of the officers’ actions. Over the course of a three-day suppression hearing, Attorney Repetto aggressively argued that the search was unlawful and that the evidence obtained should be excluded.

The Outcome

After carefully reviewing the testimony and evidence, the judge ruled in favor of our client, granting the Motion to Suppress and deeming the firearm evidence inadmissible in court. With the prosecution left with no viable case, the charges were officially dismissed on February 19, 2025.
